Mr Myers), Mr «Ju£Lic*3 H-^rdman : Mi.* Justice Adams, Mr Justice Biair. and Mr Just.ee Smith was engaged this afternoon hearing the eass of Arthur Butt, of Tnvercargill, tobacconist, Vivian Simeon Jacob, of Dunedtn, toba-ccon ist, and the Buncdm ic*baceonists' industrial Union oi Employers (plaintiffsi, against Mr Justice frazer, George Thomas Booth. and Alexander Lamonc memocrs ot tne Arbitration Court 'defendants). The plaintiffs are moving to huvo the Dudodin, Oamaru. Gore, and Inverea-rgi 11 Tobacconists' As-sj&tanis' award moved into the Supreme Court and certain parts, thereon fxaiEi'K-d nnd quashed. Bv the Court award made on March 4th, .1927, and by a sabsf,;usnt order made on March iSt-h, ' lii 29. the Arbitration Court altered the terms of the award to the effect that all persons employed as assistants in hairdressers' and tobacconists' shops within the area 1 affected by the award must become 1 members of the Otago Hairdressers' ! and Tobacconists' Assistants' Industrial Union of Workers; that all sueb assistants not becoming members of the Union shou d bo dismis-ed from employment and only members of the Union be employed by such tobacconists and i hairdressers. i The employers are attacking altcrai tions of the awards on the grounds: (1) j They did not consent to the order varvi ihg" the award, and such consent is ] necessary by law. ; <2).
