On a charge of havinc broken and enterod by day the premises of Butterworth Bros.. Lichfield street, and stolen goods valued at -150, Gr»ham Pitcaithly. a younp man. was remanded to appear on Friday afternoon. DISMISSED. After hearing further evidence- in the case in which Bernard Llewellyn Win, aged 21 years, who appeared on remand, was charged with having converted to his own use a i'aoO motor-car belonging to Joseph Tavlor, dairy farmer, Papanui, by whom the" accused was employed, his Worship dismissed the charge. When the case was first called on Monday Taylor said that Win had taken his car without permission, but Win said he had been under the impression that he could use the car if he could provide it with lights. His Worship said a doubt had been created in his mind, and Win was entitled to it. ! CIVIIi BUSINESS. Judgment by default was given for the plaintiff in each of the following cases: — City Council v. His Worship ordered Frederick Chapman to pay the Christcliurch Gas, Coal, and Coke Co., Ltd., the sum of £5 12s, in default seven days' imprisonment. NON-SUITED. Reserved jndgment was given in the case in which the Dominion Home Builders. Ltd., sued Mrs Levenia Martha Burgess-Thomas and George Burgess-Thomas, known as John George .Burgess, St. Albans, builder, for £G4 16s sd. It was alleged that the amount was due for timber materials said to have been supplied, ■ Plaintiffs also claimed a lien on land owned by the female defendant. His Worship non-suited the plaintiffs and refused to allow the claim for the lien. AN EXCESSIVE CHARGE. Miss Nellie Gunn, Lincoln road, Spreydon, was sued by David Gurdler, bricklayer, for £3 Bs, for work done to chimneys at her residence and her garden. Mr A. C. Cottroll, who appeared for Gunn, said tho claim was disputed because it was considered that the charge was excessive. The sum of £1 18s 9d had been paid into Court. His Worship gave judgment for Gurdler for the amount paid into Court only. (Before Mr H. A. Young, S.M.) BREACH OF COVENANT. Francois Charles Malmancho, farmer, of Christchurch (Mr J. D. Hutchinson), claimed from James Robert. Moore, gardener, of 3i) Queen street, Sydenham, Mrs Mary Moore, and Arthur William Moore (Mr J. R. Cuningham), the sum of £54 7s 6d. The claim was for the cost of putting into repair a property which should have been in a repaired state when yielded to plaintiff on the expiration of a lease. It was alleged that damages had been ■ suffered through breaches of a covenant. Judgment was entered for the plaintiff for I £ls and costs.
