REFUSAL OF A TRANSFER

The first Otago case in which the Crown made a challenge on the ground of undue aggregation has been decided by the Otago Land Sales Committee, which declined to approve the transfer of a residential property to a husband and wife. In giving its decision, the com mittee stated that between the husband and wife there had been a total holding of 36 properties, 10 of which had been disposed of under agreements for sale and purchase. The committee added that the statement in the purchaser's application that she intended to convert the building into flats and generally renovate it was not supported by her husband s evidence that he would sell the property for £1000 without converting it into flats.
