STREET ACCIDENT.

MARRIED WOMAN INJURED. « CLAIM FOR £1657 DAMAGES. Injuries suffered t>y a pedestriaft, Rita Louisa Lockyer, married woman, of Auckland, in a collision with a motor truck in Hobson Street on November 8, 1934, resulted in her bringing a claim for damages at the Supreme Court this morning. The defendant was John William Burgess, coal and firewood merchant, of Dominion Road, who was driving the truck and whose negligence, the plaintiff alleged, was the cause of the accident.

The statement of claim said that in consequence of the accident suffered a broken leg and other leg injuries, and was now permanently injured. She had been in hospital for four and a half months.

The damages claimed amounted to £1657, of which £1500 were special damages.

The defendant denied negligence and contended that if he was negligent the accident was due to plaintiff's contributory negligence.

The action was heard before Mr. Justice Fair and a jury. Mr. Hall Skelton appeared for the plaintiff and Mr. Finlay and Mr. Wallace for the defendant.

The plaintiff, in evidence, said she was a cook. On the day of the accident she was walking slowly across the road with the aid of a walking stick. She stopped in the middle of the road, and could not see any traffic for a long distance. She then crossed the second tram rails, and did not remember any more until she woke up in the hospital. Part of her claim was for £147 10/ for wages lost. She had a position to go to the week following the accident. Cross-examined, witness said the arrangements for the job were made by correspondence, which she had not kept. An eye-witness of the accident, Merline Meyer, stated that the motor truck was travelling at a fast speed. (Proceeding.)
