FARM'S CAPACITY DISPUTED.

£10,000 IN DAMAGES CLAIMED FRAUDULENT STATEMENT ALLEGED. (By Telegraph.—Own Correspondent.) WELLINGTON, this day. An action in which £10,000 is claimed as damages for alleged misrepresentation in connection with the sale of Ciaigdcan," a farm in the Mangamahu district, near Wanganui, has been started in the Supreme Court. The plaintiffs are a family named Harding, and the defendants are Leonard It. Tyer and Horace H. Tyer, of Featherston. Plaintiffs claim that by an agreement dated July 20, 1927, they purchased "Craigdean," a farm of 3812 acres, for £30,000, and that to induce them to enter into the agreement defendants represented that the property would winter 2500 ewes and 5500 wethers, and that it would fatten at least 3000 wethei'J and carry also 300 head of cattle. The carrying capacity, according t- plaintiffs, docs not exceed 2500 ewes, 4000 wethers, and 250 cattle. They allege that defendants made the representation fraudulently, and that the land was worth far less than the agreed price.

Defendants deny giving any warranty. They say the statement was intended, and was so understood by plaintiffs, to he defendants' estimate of what the property would winter in future if properly farmed and when parts of it in scrub were cleared. They say that they still believe this to be true, and deny that the statement was made in order to induce plaintiffs to enter into the agreement.
