AFFILIATION CASE AT WAIHI.
NOTICE OF APPEAL,
(By Telegraph.—Own Correspondent.) WAIHI, Wednesday. Argument was taken in the Magistrate's Court to-day in a case adjourned yesterday, wherein Norman Emmett, now of Auckland and formerly of Waihi, was cited as defendant in an application for affiliation and maintenance. Mr. Clark (instructed by Mr. Singer, of Auckland) said Mr. Singer was prepared to come to Court yesterday had his case been sufficiently forward to proceed. Defendant had not had sufficient opportunity to procure evidence and make inquiries. Mr. Beeche strongly opposed further adjournment without sufficient security being given. The magistrate, in refusing an adjournment, said he could see no reason why the case should not proceed.
After hearing evidence the magistrate adjudged Emmett the father of the child and granted an affiliation order. Maintenance was fixed at IS/ per w-eek. Costs and witness' expenses amounting to £10 8/ were allowed. Mr. Clarke gave formal notice of appeal, and asked* the magistrate to fix security. Counsel said Mr. Singer intended to apply for a writ of prohibition. Security for purposes of the appeal was fixed at £36 !.">/•
