"THE LAST OPPORTUNITY."
AVOIDING A MOTOR SMASH.
JURY FIXES RESPONSIBILITY.
The jury of four, which sat with Mr. Justice MacGregor in the Supreme Court yesterday to hear an action arising out of a collision between two motorists, found in favour of the plaintiff, Alfred Herman Gyllies, accountant, Auckland, and awarded £133 damages. Defendant was Boucher Hill, a clerk of Grey Lynn. There was a claim, and also a counter-claim, for £199-odd, and the task before the jury was to decide which of the parties was responsible for the accident.
Summing up, his Honor said it ap-1 peared there might have been negligence by both parties. In that case the jury would have to consider who had the last opportunity of avoiding the accident by the exercise of reasonable care.
After a retirement of 35 minutes the jury found as stated, expressing the opinion that Hill had been negligent, in that he had the last opportunity. 1
