ASSESSED AT £600.
DAMAGES IN PROPERTY EXCHANGE.
COURT ADJOURNED FOR LEGAL POINT. Damages were assessed at £600 in the Supreme Court* case in which Alfred Mason Griffiths, commission agent (Mr. Finlay), claimed £1800 from James Kennedy Popple, merchant (Mr. Northcroft), in consequence of a property exchange in which plaintiff transferred a Howick property, with a first mortgage, for a second mortgage on a 118 acre farm at Te Aroha.
After a retirement of almost _ four hours, the jury found for the plaintiff, by a three-fourths majority. In giving its verdict it held that the representations had been made with a fraudulent intent and assessed damages at £600.
Mr. Finlay asked for judgment, but Mr. Northcroft said he wished to address the Court on the question of a nonsuit, as he had previously intimated; and the case was therefore adjourned to enabletthiss s to be considered.
