The facts were that a lodger was stopped by the police when he was taking away a quantity of liquor from the premises in a car at 19 p.m. Mr. R. F. Smith (counsel for defend* ant) contended that there had been na previous reported decision on the matter, and that there was nothing in the Licensing Act to prevent a lodger purchasing liquor in any quantity for consumption off the premises. The magistrate upheld counsel's con* tention and dismissed both charges.
