RESULT OF A COLLISION.
ACTION FOR DAMAGES. Argument was heard by Mr. C. E. Cutten, S.M., at the Magistrate's Court this afternoon in the case of His Majesty the King v. the National Piano Co., Ltd., claim to recover £50 8/6 damages. It was claimed on behalf of the Crown that a collision between a motor cycle ridden by an employee of the Post and Telegraph Department, and a motor car driven by an employee of the defendant company, was due to the careless and negligent driving of the latter vehicle. Damages were claimed as follows: Injury to cycle £40 1"2/, and wages paid employee during absence £9 lfi/G, total £50 8/8. The defence was that the motor cycle was travelling at an excessive speed when the accident occurred, also that it swerved towards the motor ear. Therefore it was contended that the accident was not due to careless and negligent driving on the part of the employee of the defendant company. Mr. Cutten, in reviewing the case, said that it seemed that the driver of the motor car cut the corner without proper care. Therefore he must give judgment for the plaintiff for the amount claimed. Mr. Selwyn Mays appeared for the prosecution, and Mr. J. W. Dickson for defendant.
