STRUCK BY A MOTOR CAR.

As the outcome of the motor car accident in Dominion Road on October 5 of last year, in which a small boy named Philip Roland Hartnell was severely injured, the father of tiie lad brought an action for £16 19/ special damages and £1,000 for general damages against Oswald James Melvern, who was driving the car at the time of the mishap. This afternoon at the civil sittings of the Supreme Court his Honor Mr Justice. Cooper and a jury of twelve were engaged in hearing the case. Mr .7. R. Reed, K.C., and Mr Kndean appeared for the claimant, nnd Dr. Bamford and Mr Prendergast for t he defendants. The details of the accident, as alleged in the statement of claim were that on the date mentioned the defendant was driving his car alons Synonds. Street from Onslow Street to Lhe city at an excessive speed, and ran into the little boy, who was crossing the road. The youth was knocked down with great force, and sustained a fractured skull, a fractured pelvis, and injuries to Tiis left arm, which had rendered it permanently useless. No intimation \va- given by the driver of. the car thai he was approaching. Thei medical expenses incurred were £16 I!'/, and in addition to this general damages ol £1.000 were asked.
The statement of defence denied any negligent driving, also the allegation tluit the motor horn had not been Hounded. Contributory nor- ou '.he part, ot the Uid wat'al.so alleged. Phillip Roland Hartneil, a bright little lad, whose left arm dangled limply in a slinjr, stated that he was crossing the road, and did not see or hear thi> motor ear at all. He did not remember beuig knocked down. The evidence for the prosecution was still being heard when the "Star ,, went to press.
