THE CALLIOPE DOCK CASE.
Thp. legal Commitiee of the E_a_-—C 'Board reported at the meeting of tba_ Ibtody yesterday afternoon, jegardirigj the result of tbe recent Supreme- Court action. The report stated that the committee deemed it desirable to secure the attendance of several witnesses front Australia, and wished to express their thanks to the authorities who ki->_y permitted their officers to come to New Zealand and give evidence. The report concluded, "The result of the case has proved conclusively: 1. That the Calliope Dock was well and properly constructed. 2. That the dock was we— and properly equipped. 3. Tnat no employee of the Board was guilty of negligence in or about the docking of the plaintiffs steamer Mamari.'' Mr. G. W. Basley moved: —"That the special thanks of the Board be given, to Mr. Napier for his services on behalf of the Board in the recent action brought in the Supreme Court against the Board by the -Shaw, Savill and Albion Company, Ltd., such services having largely contributed to the Board's success in the case." Mr. Basley said it was particularly owing to Mr. Napier's suggestions that expert evidence was brought from Australia, and it was largely due to the evidence of these experts that the jury gave a verdict for the Board. It was greatly due to Mr. Napiear's energy that the Board had secured the victory. It was Mr. Napier wbo said, "We must fight this, no mattter what it will cost." The result showed the wisdom of the Board doing so. The motion was adopted and added to the report of tbe Legal Committee. Mr. Napier expressed, his thanks for tbe kind remarks made by Mr. Basley. The Board was) to be congratulated upon having won the case. It was his knowledge oi how well tbe dock was constructed, that made fri™ so determined to fight the case, and his advice was taken by the other members of the Legal Com- ] mittee.
