£1,554 FOR THE MONTH.
The quantity of ore put through this Company's battery during the past month was not so large as usual owing to the scarcity of water for power purposes. The value per ton of the ore treated was, however, about the same. The quantity of ore crushed for the month ending December 4th was 1,150 tons which yielded bullion valued at £1,554. It is expected that the reef in the lower level will be cut about the third week of January.
At Paeroa Warden's Court on Dec. 16 the action Mary Devlin v. the Waihi-Silver-ton Company, claim £1,000 for pecuniary loss sustained by the plaintiff by the death of her husband through neglect of the defendant Company, came before the Warden. Mr Jellicoe appeared in support and Mr Theo. Cooper for the Company. The facts were admitted, and tlie matter resolved itself into a question of damages. Mr Jellicoe contended that the Employers Liability Act 18S2 had nothing to do with this case, which should be decided by death by accidents in the Compensation Act, 1880. After short addresses by both counsel on this point and the earning power of the deceased husband of complainant, His Worship gave judgment for £500 for the widow and £250 for the children. Prior to argument, an agreement was handed in to Court signed by both counsel that this action was without prejudice to the right of complainant to appeal to the Privy Council on the decision of the Court of Appeal, and that should complainant so appeal, and gain the appeal, then the Warden's decision should lapse, and if the appeal was dismissed, costs of such appeal should be deducted from the amount awarded by the Warden, time being allowed for appeal and Warden's indgment being held back from execution m the meantime.
