SUBDIVISION PLAN APPEAL. (P.A.) INVERCARGILL, August 5. - A decision -in a case which has aroused special* interest- in legal 1 circles was given to-day by an appeal board set up under the Municipal Corporations- Act. The case was one in which Mrs C. H. Roberts, of Invercargill, appealed under a, section of the Act against the decision of the Invercargill City Council to refuse approval of a plan for .subdivision of a property of a little more than an acre in River Road, Gladstone. The Appeal Board, which consisted of Mr R. C. Abernethy, S.M. (chairman), Mr D. E. S. Mason (Bluff), and Mr John T. Carswell, held that the appeal should be allowed and the subdivision approved by the council. The City Council was ordered to pay the costs of the board, and costs, £2l 10s, to the appellant. So far as is known, this is believed to bo the first decision given under the particular section of the Municipal Corporations Act! The Council had refused permission because of the low-lying nature of the ground, and its liability to flooding.
