MAGISTRATE IN ASHBURTON.

SMALL LIST FOR HEARING.

COLLISION CASE CONCLUDED. There was a moderate list of cases for hearing before Mr H. Morgan, S.M., in the Ashburton Magistrate’s Count this morning. Breaches of Award. George Gourdie (Mr Drury), pleaded guilty to a breach of the Carpenteis and Jqiners’ Award and one of haying employed an unregistered apprentice. Mr Drury said that defendant had employed the lad at the urgent iequest of the lad’s father. In regard to the other case, a man was employed at a lower rate, of pay because he did not have the necessary experience. He had been taken on at a rate he was willing to take. Defendant was fined £1 on each charge, with 7s 6d expenses. Breaches of By-Laws. Arthur Campbell, charged with having ridden a bicycle at night without a light, was fined 7s 63, with 12s costs. Donald R. Cox, similarly charged, was fined 7s 6d, with 10s costs. Alexander A. Shivo was fined 7s Gd, with 10s costs, on a like charge. Delivery of Firearm. A. Colville was charged with having delivered possession of a firearm without a permit. It was stated that the rifle had been lent to defendant’s son. . Defendant was ordered to pay 12s costs. j Collision Sequel. The case in which Frederick Thomas Shannon, train examiner, was charged with having driven a motor car in East Street in a negligent manner, was resumed after having been adjourned two weeks ago. Defendant, who was represented by Mr' Tv. A. Charles, had pleaded not guilty. The case arose out of a collision between Shannon’s car and a car driven by Alfred Bray. In the box, defendant stated that he was driving north along East Street, starting at tho railway station, about a block and a half from tho scene of the collision. There was a car in front of him. He wished to turn into Grey Street, and blew the horn, placing his hand out to indicate ho was about to turn. He could see about 21- chains along East Street, and it was clear. Then Bray’s car appeared in front of him. He thought Bray would avoid a collision, but the cars met and defendant’s car was swung right round. Bray swerved only slightly out to his right. Bray was about a chain away when defendant first saw him.

,T. H. A. Hayward, engine driver, said he was at the north end of the engine sheds, nearly opposite Grey Street, when he saw a car approaching along East Street from the south. He did not know at the timo whose car it was. He saw the driver put out his right hand to indicate a turn into Grey Street.

The Magistrate held that defendant should have been able to see the other car approaching and that he had been negligent. Defendant was fined 30s, 'with 13s costs.

Civil Business. Judgment for plaintiff by default was given in the following cases:— \V. John v. AV. H. Tait, £1 0s 6d, with 8s costs; J. Strachan v. AV. F. Colville £1 13s with 10s costs.
