MCARTHUR’S APPEAL FAILS. TIME FOR FURTHER APPEAL. (United Press Association—Copyright:) SYDNEY, December 24. The Full Court to-day dismissed the appeal of J. AY. S. McArthur against a Magistrate’s order that he be returned to New Zealand to face a charge of having issued a prospectus false in certain respects. The Full Court ordered that McArthur should not he returned until January 31, unless the High Court ordered otherwise. The period of grace was allowed so that McArthur might seek from the High Court special leave to appeal against the decision. Bail was fixed at one surety of £SOO and a personal surety of £SOO, and McArthur was ordered to report to the police once a week. The Court was unanimous in dismissing McArthur’s appeal, and by a majority ruled that the warrant for his arrest issued in New Zealand was valid. Air Justice Street dissented from the latter part of the judgment, but did not publish his reasons. Referring to the New Zealand warrant, Mr Justice Bavin said he could see no ground on the evidence -before him that the warrant had been issued without jurisdiction.
