THE NAYLOR CASE. CLUB GETS DECISION. ! United Press Association—Copyright) \ SYDNEY, May 31. Mr Justice Street, in the Equity Court to-day, dismissed Rufus Naylor’s application for an interim injunction restraining the Australian Jockey Club from acting under by-law nine, which empowered the club to exclude from the racecourse persons whom, within its discretion, it deemed undesirable.
The judge said that the words of this by-law obviously meant undesirable from the point of view of the management of horse racing at Randwick racecourse as a sport. The legislature had invested the Australian Jockey Club with the power to make by-laws for the general management and control of lands comprising the racecourse, and it was apparent that the legislature intended that the club should have the right to say what class of person should not enter the racecourse. It was common knowledge that undesirable persons attended racecourses for the purpose of earning a livelihood various and devious dishonest methods. The judge could not regard it as unreasonable that discretion should be conferred upon the Australian Jockey Club committee to exclude oi; expel such persons. He thought it desirable in the interests of all concerned, and particularly of horse racing as a sport, however, that the committee should, before acting upon this by-law, give the person involved an opportunity oi being heard.
