SUPREME COURT JUDGMENT.

Per Press Association. ■''■... CHRISTOHURCH, September 27. In the appeal case W. S. Harkness v. C. N, Orbell, an appeal against the. decision of the Magistrate who convicted appellant for using a traction engine on a road m the Levels county without having been registered -under the Council's by-law, and for' having used on the , same road a truck not licensed.

Mr Justice Sim dismissed the appeal m the first case (referring to the annual registration fee of 10s an engine), but allowed the appeal m the second (the £5 license per truck). The lastmentioned case was therefore remitted to tho Magistrate with an intimation from the Court that it .should be dismissed.

Seen^last evening by a Timaru Herald reporter, Mr Kinnerney, who appeared for the appellant. Harkness, said the effect of the judgment was a substantial success for traction-engine owners, as the by-laws as to the licensing of vehicles have been set aside as illegal. The license imposed by the Council. is £5 per truck, while the registration fee is only 10s for each engine.
