WELLINGTON, Jue 7. In the Supreme Court- Mr Justice Cooper gave judgment m the case, Jack v. Palmerston Borough Council. The question, of general interest involved Was whether or not the local body had a right to authorise one, and only one, type of appliance for any particular work, and exclude all others. The Judge said that the Council must be presumed to know what is best m the interests of the borough, and must be credited with having exercised its ■ discretion with due regard to such interests: The Court could not usurp the .functions of the Council m a matter within the discretion of that body.
