THE PUBLIC SAFETY EMERGENCY REGULATIONS 1940, AMENDMENT NO. 4.

C. L. N. NEW ALL, Governor-General. ORDER IN COUNCIL. At the Government House at Wellington, this 26th day of March, 1941. Present: His Excellency the Governor-General in Council. Pursuant to the Emergency Regulations Act, 1939, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS. 1. (1) These regulations may be cited as the Public Safety Emergency Regulations 1940, Amendment No. 4. (2) These regulations shall be read together with and deemed part of the Public Safety Emergency Regulations 1940* (hereinafter referred to as the principal regulations). 2. The principal regulations are hereby amended by inserting in Regulation 2a (as enacted by the Public Safety Emergency Regulations 1940, Amendment No. 1), after clause (6) thereof, the following new clauses : “ (6a) In any case where under the foregoing provisions of this regulation an organization has been declared to be a subversive organization the Attorney-General may, by notice published in the Gazette, consent to the carrying-on of such of the activities of the organization as do not have a subversive tendency and as in the opinion of the Attorney-General may be carried on without being injurious to the public safety. “ (6b) Any such consent may be given upon or subject to such conditions as the Attorney-General thinks fit, and may authorize the payment of moneys to or for the benefit of the organization for such purposes as may be specified in the notice. “ (6c) Any such consent may by notice published in the Gazette be amended or revoked.

“ (6d) No such consent or conditions shall be deemed to be invalid on the ground that any discretionary authority is thereby conferred on or delegated to any person. “ (6e) In any case where any consent is given as aforesaid no person doing any act, or allowing any act to be done, in pursuance of and in accordance with the consent shall be deemed to have committed an offence against this regulation.” C.
