Circular No. 8/1938.] Production in Civil Cases of Statements made to the Police in Relation to Accidents in which Motor-vehicles are Involved. In all civil cases arising out of accidents in which motorvehicles are involved no objection will now be offered to the production under subpoena of any plan of the scene of an accident made by a member of the Force or of any statements relating to the accident made to the police by the parties to the action or by persons who were passengers in the motor-vehicles involved in the accident.

Statements relating to motor accidents made to the police by independent witnesses and statements relating to any matter other than vehicular accidents must not be produced in civil actions without authority from this office. A member of the Force is compellable to the same extent as any other individual to testify to matters of fact directly observed by him, such as the movements and positions of persons and vehicles, and whether the observations were casual or taken by formal measurement. He should, however, not attend except under subpoena, and when subpoenaed should immediately inform his superior officer of the fact. He should not, without the authority of the Officer in Charge of the District, permit a proof of his evidence to be taken beforehand or in any way indicate the nature of his evidence. The memorandum of 13th November, 1935, appearing in Police Gazette, 1935, page 683, and relating to evidence of police in civil actions is hereby cancelled. D. J. Cummings, Commissioner of Police.
