Memorandum.] Injury to Telegraph or Telephone Lines by Motorvehicles. Where injury is caused unlawfully to any electric telegraph’ line or works by a motor-vehicle it is desirable that prosecution be taken, not under Die Motor-vehicles Act, but/under the Post and Telegraph Ant, 1928 (see sections 212 / to 215), £/ for the reason that byAnis Act the onus of disproving carelessness is on the defendant, and, further, he is/tiable on conviction to makegood the damage done by him. Officers of the Post and Telegraph Department who become aware of damage to departmental electric lines, works, or property'Dy drivers of motor-vehicleywvill inform the police, and supply estimates of costs of effecting repairs or replacement, so that the police may apply4o the Court for the amount of damages. / W.
