Accused, by falsely representing that he was a member of the Amalgamated Society of Railway Servants, Wellington, solicited and collected from farmers contributions on behalf of the widows and orphans of the Ongarue railway disaster.

Accused, who was employed as cashier and ledger-keeper by complainants, received the amount from May Beresford on terms requiring her to account for it to her employers, but failed to do so. Clarke and stealing therefrom a Dodge motor-car (recovered), value £3O, the property of Dr. Lawrence, James Raymond Smith, age twenty-five, height 5 ft. 10 in., winchboy, native of New Zealand, medium build, dark complexion, black hair, brown eyes, right eye artificial.
