FINGER-PRINTS.

Extract from the Sydney Morning Herald of the 20th May, 1910, reporting a further application to the High Court in th 6 case Rex v. Blacker, published in the New Zealand Police Gazette of the Ist June, 1910. The High Court. (Before the Chief Justice, Sir Samuel Griffith, Mr. Justice O’Connor, and Mr. Justice Isaacs.) Leave to Appeal refused.

Application was made by Mr. Betts (instructed by Messrs. Gale and Paine, Moss Vale) for speoial leave to appeal in the case of the King versus Robert Stephen Blacker, from the judgment of the Full Court of 13th May, confirming Blacker’s conviction on a charge of wounding with intent to murder one Ah Fung, a Chinaman. Mr. Betts based his application on the grounds that the presiding Judge, Mr. Justice Pring, was in error in admitting certain evidence in the shape of a photographic enlargement of finger-prints appearing upon a box. The ordinary fingerprint was just perceptible to the eye, and it was impossible to distinguish between one finger-print and another. His second ground for objection was that in submitting an enlarged photograph of the print the expert showed only a portion of the thumb.

The Chief Justice : Then it might be contended that a photograph of a particular window in a house would be inadmissible because it was not accompanied by a picture of tho remainder of the house.

Mr. Betts submitted that it would be very dangerous to allow an expert to take a photograph of a portion of a print, and to point out to a jury that portion of the thumb which exhibited characteristics identical with those in a print taken from the prisoner when in custody, without showing the whole thumb-print, to enable the jury to decide whether there were other characteristics which might or might not correspond. Leave to appeal was refused.
