Rewards.

Uniform

(Circular No. 14/01).) It affords me much gratification in communicating to the Force generally that Cabinet has been pleased to authorise the free issue of uniform to all sergeants-major, sergeants, and constables, as per schedule annexed. This free issue will commence from Ist October next, and the first issue will be made on requisition, as the various articles then in use become unserviceable.

Inspectors will be held responsible that this first issue is not requisitioned for until the articles are actually required, and all subsequent issues will be made according to the periods named in the schedule, and dating from the first issue. Where materials are issued to be made into articles of uniform, the Inspectors will take all necessary precautions to insure that such materials are made up into the garments for which they are intended, within one month of suoh issue. The cost of making up must be borne by the officer concerned.

DWYER V. HERMANN. (“New Zealand Law Reports,” Volume xix,, pages 209-13.) Licensing Acts — Offences —Sale to Drunken Man—Sale to Another for Consumption by Drunken Man —“ The Licensing Act , 1881,” Sections 146, 170. Section 146 of “The Licensing Act, 1881,” provides that if any innkeeper sells any liquor to any person already in a state of intoxication he shall be liable to a penalty. A sober man applied for and obtained and paid for a glass of liquor to be consumed, and which was in fact consumed, by a drunken man on the premises. There was no evidence pointing to collusion between the two men, or to agency. Held, That no offence had been committed by the innkeeper within the above section. Scatchard v. Johnson (57 L.J. M.C. 41) distinguished.

This was an appeal from the dismissal by H. Eyre Kenny, Esq., S.M., Wanganui, of an information charging the respondent with an offence under section 146 of “ The Licensing Act, 1881.” The facts of the case are sufficiently stated in the headnote and judgment. S. T. Fitzherbert, for the appellant: In the English decisions a distinction is drawn between the class of cases coming under the head of “ Offences against Public Order,” of which the present is an instance, and cases such as Pine v. Barnes (20 Q.B.D. 221), which came under the head of “ Illicit Sales.” The judgments in Cundy v. Le Gocq (13 Q.B.D. 207), Commissioners of Police v. Cartman ([1896] 1 Q.B. 655), and Scatchard v. Johnson (57 L.J. M.C. 41) indicate that the innkeeper is responsible if, as a matter of fact, a drunken person is supplied with liquor, and that the ignorance of the innkeeper as to his customer’s condition is merely a ground for reducing the penalty, but is not an answer to the charge. In White v. Nestor (13 N.Z. L.R. 751), which is the case relied upon by the Magistrate in dismissing the present information, Richmond, J., apparently with some reluctance, followed Pine v. Barnes ; but the oharge in that case was laid uuder a different section, and it was merely a case of illicit sale. Moreover, Pine v. Barnes was referred to in Scatchard v. Johnson, and the Court did not consider it an authority in case of an information laid under section 3 of the English Act, which corresponds with section 146 of “The Licensing Act, 1881.” Counsel also referred to McVeigh v. Eccles (18 N.Z. L.R. 44), Corbet v. Haigh (5 C.P.D. 50), and Miller v. Hobson (17 N.Z. L.R. 225). Barnicoat , for the respondent: The Magistrate found as a fact that there was no sale under section 146. “ Sell ” does not mean “ supply for consumption.” The Licensing Acts distinguish between procuring liquor for another and a sale : See sections 166, 167, 168, 169, 191 of the Act of 1881, section 12. (8), of the Act of 1893, and section 25 of the Act of 1895. Scatchard v. Johnson is distinguishable. In White v. Nestor, Richmond, J., held that “ sell ” did not mean “supply for consumption," and distinguished and explained Scatchard v. Johnson. S. T. Fitzherbert in reply.

Stout, C. J.: The facts in this case are simple : A drunken man named Frederick Jones was in the bar of the Rutland Hotel on the evening of Mafeking night. The bar was crowded with persons manifesting their joy by drinking various kinds of intoxicating liquors. A Mr. Scally came into the bar with two others and called for drinks. Seeing Mr. Jones, and Mr. Kershaw, his companion, present, he recognised them as acquaintances, and offered them liquor, ordering some from the barmaid. The liquor was supplied as ordered, and Mr. Scally paid for it. An information was laid by the appellant, who is a police officer, against the respondent, who is the licensee of the Rutland Hotel, charging him with a breach of section 146 of “ The Licensing Act, 1881.” This section says, “If any innkeeper . . . sells any liquor to any person already in a state of intoxication . . . he shall be liable to a penalty,” &c. Tnis section is similar in language to section 13 of the English Licensing Act, 35 and 36 Viet., c. 94. On the English statute several cases have been decided. One case very much like this is that of Scatchard v. Johnson, decided in 1888. In that case the facts were as follows: Two men came into a publichouse together : one was drunk and the other was not drunk. The sober man applied for and obtained and paid for a glass of rum supplied to the drunken man. The Magistrate held that, the rum having been knowingly supplied to the drunken man, it was in the nature of a sale to him. The Divisional Court of Appeal (Cave and Smith, J.J.) upheld the decision. Reliance was placed on the 62nd section of the Licensing Act, which is similar to section 170 of our statute. It states, “In proving the sale or consumption of liquor for the purpose of any proceeding relative to any offence under this Act, it shall not be necessary to show that any money actually passed or

any liquor was actually consumed, . . . and proof of consumption . . . shall be evidence that such liquor was sold to the person consuming,” &c. The Supreme Court (per Richmond, J.) had occasion to consider the effect of this section in a sale after hours, being an offence under section 155, which says, “ Anv person who . . . sells . . . any liquor shall,” &o. It was held in that case—White v. Nestor —that the section (170) only meant that consumption was prima facie evidence which the accused could displace. The case of Pine v. Barnes was followed, and Scatchard v. Johnson was distinguished. I am of opinion that this section does not mean that the proof of consumption is conclusive evidence. It is prima facie evidence which will have to be displaced, and in the absence of other evidence would be conclusive. Here the evidence was, and the Magistrate has found, that liquor was ordered and paid for by Mr. Scally, and not by the drunken man. It was argued that permitting drunkenness or selling to a drunken man is an offence against public order, and different considerations should apply to this class of offenoe from those which apply to sale at improper hours to men not in a state of intoxication. The section under which the information is laid is one of a group (142 to 153, both inclusive) under the cross-heading of “Offences against Public Order.” The sections dealing with illicit sales are 144 to 175, both inclusive. I do not think it is permissible to strain the words of the Act to carry out what was no doubt tbe intention of the statute. This is a statute dealing with crimes, and if an act does not come within the words of the section defining a crime, the Court cannot enlarge the words to suit the act and to make it an offence. Before I could reverse the decision of the Magistrate I should have to read into the statute some additional word, such as “gives” or “ supplies,” after the word “sells.” It may be that interpreting the word “sells” strictly will lead to many offences that were meant to be reached going unpunished. That, if so, is for the Legislature to deal with. I have only to interpret the law as I find it. Where the Legislature has meant to make supplying, as distinct from selling, intoxicating liquor an offence, it has used proper words. For example, in section 24 of “ The Alcoholic Liquors Sale Control Act Amendment Act, 1895,” the section reads, “ If any person . . . sells or in any way gives or supplies, or allows to be sold, given, or supplied, any liquor,” &c. Some words, similar in import, will have to be added to section 146 to meet cases of this nature. To meet the state of things pointed out by White v. Nestor the Legislature enacted subsection sof section 22 of the statute last mentioned. If in this case Mr. Jones and Mr. Scally had come in together to tbe bar of the hotel, or been seen drinking together before their meeting in the bar of the hotel, or if there were any evidence pointing to any collusion between them, or any evidence of agency, or if it could be supposed Mr. Jones was to repay Mr. Scally for the drink supplied, the case would have been within the decision of Scatchard v. Johnson. Tbe facts, however, are different. I need not add that hotelkeepers and their employes run a great risk by allowing men in a state of intoxication to be on their premises. The appeal must be dismissed. It is not usual to give costs against the police unless it is clear the proceedings should not have been taken. I think, looking at the decision in Scatchard v. Johnson, this was a proper case to bring before the Court, and, under these circumstances, no costs will be allowed.

Amended Regulations for the Sale of Arsenic and Strychnine

IN pursuance and exercise of the powers and authorities vested in him by “The Sale of Poisons Act, 1871” (hereinafter termed “ the said Act”), His Excellency Uchter John Mark, Earl of Ranfurly, the Governor of the Colony of New Zealand, acting by and with the advice and consent of the Executive Council of the said colony, doth hereby revoke the regulations made under the said Act on the thirty-first day of March, one thousand eight hundred and ninety-two, published in the New Zealand Gazette of the seventh day of April, one thousand eight hundred and ninety-two, and in lieu thereof doth hereby make the regulations following with respect to the sale of certain poisons, and doth declare that these regulations shall come into force and take effect on and after the fifteenth day of July, one thousand nine hundred and one

Regulations

1. “ The Sale of Poisons Act, 1871,” is hereinafter referred to as “ the said Act.”

2. It shall not be lawful for any person to sell or dispose of strychnine or arsenic in any quantities unless such person shall, previous to making the entry required by the provisions of the twelfth section of the said Act, obtain from the intending purchaser of such strychnine or arsenic a written statement from such purchaser setting forth the particulars hereinafter mentioned ; and such statement shall be signed in the presence of the seller, and witnessed by him, and also by any person introducing the purchaser to such seller. 3. Immediately upon completion of the purchase the seller of such poison shall forward such written statement to the Registrar of the district appointed under the said Act: Provided that this and the preceding regulation shall not apply to the sale of arsenic wholesale for use in the cure of diseases in sheep. 4. Every such written statement shall set forth precisely (1) the Christian name and surname of the intending purchaser at full length, together with his or her occupation and address ; (2) the exact quantity and name of the poison required; and (3) the express purpose or purposes for which such poison is alone intended to be used, and the places or localities where the same is to be used or deposited respectively.
