And, whereas it is desired to vary the said Order in Council in manner hereinafter set forth : Now, therefore, His Excellency the Governor of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by section twenty-nine of the said Act, and of all other powers enabling him in this behalf, doth hereby vary the said Order in Council, in the manner hereinafter set forth, and doth hereby declare that— (1.) The provisions of the first proviso to clause (2) of the said Order are hereby revoked so far as they relate to works of which the country of origin is Italy. (2.) in the application of the provisions of clause (3) of the said Order to works of which the country of origin is Italy, the reference to the commencement of the said Act shall be deemed to be a reference to the commencement of this Order. (3.) In the application to works of which the country of origin is Italy of paragraph (d) of subsection two of section three and section twenty-five of the said Act, the references to the commencement of the said Act in subsections seven and eight of the said section twenty-five shall be deemed to be references to the commencement of this Order. (4.) Where any person has, before the date of this Order, taken any action whereby he has incurred any expenditure or liability in connection with the reproduction or performance of any work at a time when such reproduction or performance would, but for the making of this Order, have been lawful, nothing in this Order shall diminish or prejudice any rights or interest arising from or in connection with such action which are subsisting or valuable at the said date, unless the person who by virtue of this Order becomes entitled to restrain such reproduction or performance agrees to pay such, compensation as, failing agreement, may be determined in accordance with the provisions of the said Act. (5.) This Order shall come into operation on the first day of June, one thousand nine hundred and fourteen, which date is in this Order referredjfco as the commencement of this Order. J. F.
