Abuse of the Court
“It is a pity inquiries are not made before some of these summonses are taken out,” said Mr Miller, S.M., when hearing debt cases in the Magistrate’s Court at Napier. He said the Court should not have actions brought before it against persons in hospital and on social security where there was no chance of the claims being successful. “It is simply an abuse of the procedure of the Court,” he said.
