FAILED TO GIVE WAY

MOTORIST CONVICTED CAR AND VAN COLLIDE Arising out of a collision between a van and a car on the intersection of Mill and Ulster Streets, on January 8, Clifford Selwyn Blade, the driver of the van (Mr J. C. Taylor), was charged before Mr S. L. Paterson, S.M., in the Magistrate’s Court, Hamilton, yesterday, with failing to give way to traffic on the right. Defendant pleaded not guilty. Richard John Casey, tne driver of the car, said he was proceeding along Mill Street from Victoria Street, When he approached the intersection with Ulster Street he blew his horn and looked to the right. He then proceeded to cross tne intersection at a speed of from 20 to 25 miles an hour. He then noticed a van approaching along Ulster Street, travelling at a good pace. He turned to the right in an attempt to avoid a collision, but the van struck his car. Speed of Van Wynn Henry Castleton, a labourer, said he was working in a garden near the intersection when the van passed him at what he considered to be 40 to 45 miles an hour. He heard a bang and saw that two vehicles had collided. “I should say that the car was just entering the intersection when the van was anything from a half to twothirds on to the intersection,” said another witness, John William Lewis, borough inspector. He could not say at what speed the car was going, but he did not see any check in its speed or the driver apply his brakes. Visibility was reasonable at the time and the road was quite dry. The defendant said he approached the intersection at 25 to 30 miles an hour and was on it when he first saw the car. He contended that if it had not been going so fast or had attempted to slow down, the accident could have been avoided.

In convicting Blade the magistrate said the fact that the driver of the car might have been gu,il>y of negligence did not affect the case. Defend-
