CARS IN COLLISION.

CLAfIVI AND COUNTER-CLAIM. ,1 t 7 DG-MENT FOR PLAINTIFF. Alleging negligence arising out of a collision, Joseph Albert Gower, farmer, of Taupiri, claimed £IG 3s 3d from Frederick William Forsman, carpenter, of Hamilton, before Mr S. L. Paterson, S.M., in Hie Magistrate’s Court, Hamilton, yesterday morning. Mr W. P. Gray appeared for plaintiff and Mr F. Swarbrick for defendant. Defendant counter-claimed for . £l4 10s damages. Plaintiff's case was that his son, Alan Gower, was driving his car towards Gordonton along Tramway Road about 7 p.m- on September 30 last when it was involved in a collision with defendant’s car at the intersection with Jnsoll Avenue. It was alledged that defendant, coming along Tramway Road towards Hamilton, turned suddenly without warning into Ingo 11 Avenue and a crash occurred The damages were claimed for repairs, etc., to the car. Defendant claimed that the accident was due to plaintiff’s negligence. Defendant, sail) he sounded his horn and signalled a right-hand turn twenty yards away. He was over the intersection when plaintiff crashed into his car, which was knocked back some distance. His speed had been about 10 miles per hour. The magistrate said it was obvious from defendant’s own statement that lie was negligent. Defendant turned across in front of plain tills car and also cut the corner. Urdinary prudence dictated that defendant should pave either waited till plaintiffs car had passed or made sure ho would give way. Judgment was entered for plaintiff for £l4 13s 3d with costs £1 IGs, witnesses’ expenses, £1 3s Gd. ami solicitors fees, £4 14s- ,
