SUCCESSFUL APPEAL.

DOCTOR’S CONVICTION QUASHED. ASSAULT CHARGE BY NURSE. GREYMOUTH, Friday. The medical superintendent of the Grey Hospital, Dr. John William Brklgmen, was to-day successful in an appeal to the Supremo Court against a conviction on March 27 toy the magistrate, Mr 11. Morgan, on a charge of assaulting Ellen llaydon, a nursing sister. The grounds of the appeal were that appellant did not assault respondent and that there was no evidence upon which the magistrate could convict. Also that the magistrate was wrong in law and in fact in convicting appellant. Mr Justice Northcroft, in giving judgment, said lie was far from satisfled with the evidence of the respondent, who impressed him as not candid in some respects, and in others of attempting to mislead him. Apparently her mind was made up to embarrass the appellant, and he was quite satisfied on the evidence 'he would not toe justified in holding the charge proved. The convicition was quashed. Costs were allowed appellant.
