MOTOR COLLISION.
NEGLIGENCE PROVED.
DAMAGES, £32, AWARDED.
Reserved judgment was given by Mr. F. H. Levlen, S.M., in the Hamilton Magistrate’s Court this morning fn the case heard last Tuesday in which Smith and Smith Ltd., merchants, ot Auckland, claimed £32 3s damage from William John Woods, contractor, of Tahuna.
The action arose out of a collision on the Hamilton-Te Awamutu highway on August 10, 1932, between a car' driven by P. G. Murdoch, salesman employed by plaintiff company; and a car driven by defendant. Mr. W. J. King appeared for the plaintiff and Mr. A. L. Tompkins represented defendant. In his judgment Mr. Levlen expressed the opinion that the accident was definitely the result of negligent driving by the defendant. It appeared he was either wholly on his incorrect side or so far as to prevent him getting back on his correct side without a distinct swerve to the left. The defence was that the steering gear of defendant’s car was at fault but ther# was no evidence to corroborate defendant’s statement. Plaintiff was therefore entitled to recover.
