LONDON, May 12
His Honour, Mr Justioe Beazley, In the County Court at Hull, gave judgment in favour of Messrs White and Sons on a claim in respect to damaged apples carried aboard the Hobson Bay in 1931. This is a test case, and is likely to go to the Appeal Court. The defendants pleaded “inherent vice" in the apples. The judge, however, found that the fruit was sound when shipped, but It was carried in an uneven temperature, constituting “failure to exercise due care in the custody of cargo.” TEKOA’S SHIPMENT.
