ROUTE OF A ROAD
RAGLAN COUNTY SUED. JUDGE RESERVES DECISION. AUCKLAND, Saturday. In the Supreme Court yesterday, legal argument was concluded before Mr. Justice Smith in the dispute over a road that had been wrongly placed on a farmer’s land near Huntly. It was admitted that a piece of road had been formed along the wrong side of a boundary fence more than 20 years ago and used ever since. The error was discovered in 1927 as a result of a new survey. The plaintiff was William Robert feather, of Huntly, farmer, who claimed £l3O damages for land wrongfully taken against the Resgistrar-Gen-eral of Land and the Raglan County Council. It was stated on Thursday that the adjoining owner had built a house on-the true line of the road. The defence alleged that Leather was responsible for the error, and disputed the valuation he put on the threequarters of an acre of land taken. The defendants denied in any case the plaintiff’s, legal right to recover damages. Decision was reserved by Ills Honour.
