CLAIM FOR £5,000. COMPANY PROMOTER’S ACTION. (By Telegraph.—Press Association.) AUCKLAND, Wednesday. Remarking that he had a suspicion that plaintiff was playing with the Court, Mr. Justice Herdman to-day refused to grant an adjournment of the action brought by Harry Clinton McElwain, company manager and a promoter ol the Speedwell Oil Company, against R. N. Chisholm (accountant), E. W. Lane (farmer), Richard Arthur (engineer) and G. E. Smerdon (jeweller). Plaintiff alleged malicious prosecution and claimed £SOOO damages. His counsel, who was engaged only on Monday, was granted permission by the judge to withdraw, and the case was struck out.
