THE CROUPIER CASE

APPLICATION FOR COSTS. AUCKLAND, Thursday. In the Supreme Court yesteday, on behalf of J. J. Corry, merchant, of Blenheim, Mr Thomson applied for costs for the action regarding the ownership of the racehorse Croupier, for the appointment of a receiver to take control of Croupier pending its sale for the taking of accounts and the’wining-up of Hie partnership between Corry and John and James Paterson, merchants, of Auckland. Mr'Thompson said it was obvious that a receiver must be appointed. Mr Indcr said that accounts were to be taken by the registrar, and the question of receivership should be In his hands, too. This was agreed to, His Honour remarking that the registrar might delegate his duties to someone he selected. Referring to the fact that the Court of Appeal had altered His Honour s judgment, Mr Thomson, In asking for costs, said that the plaintiff Corry had been successful in every part of the action except One in the final result.

His Honour said the case was a singular one, because if a certain document made known to the Court of Appeal had been discovered by the plaintiff earlier he did- not suppose there would have been any litigation at all. The case would have been settled, because the document made it clear that there was.a joint interest in the horse.

His Honour said he could not see that there was any justification or excuse for the non-discovery of this vital document signed by Corry and James Paterson acknowledging that the animal was jointly owned. All the parties were at fault, and they must therefore be held equally responsible for the costs to which They had been put.

He directed that each party pay its own costs, and made an order appointing the registrar of the Supreme Court receiver of the horse.

Sweepstake events of £2 each starter will be the Waipa Plate of £7O w.f.a. (six furlongs), and the Hack Cup of £BO (six furlongs), a trophy to the value of £3O also going to the winner of the latter. The Pirongia Hurdles of £9O (one mile and a half) ; Kihikihi Handicap of £75 (seven furlongs); Paterangl Handicap of £BO (one mile), and Ohaupo Hack Handicap of £75 (seven furlongs), complete the programme. Nominations for all events will close with the secretary (Mr J. G. Wynyard), Te Awamutu, or Messrs- Blomfield and Co., Auckland, at 5 p.m. on Friday next, December 2. MANAWATU MEETING. Nominations for all events. at the Summer meting of the Manawatu Racing Club and forfeit for the Stakes will close at 9 p.m. to-morrow (Friday), with the secretary (Mr V. T. Dibble), Palmerston North. THE AUCKLAND CLUB. General entries for the Summer meeting of the Auckland Racing Club and forfeits for Derby, Royal Stakes and Foal Stakes are due with the secretary (Mr W. S. Spence), at 5 p.m., on Friday, December 2.
