CLAIM FOR COMPENSATION
RAILWAY DEPARTMENT SUED. ALLEGED DEPRECIATION IN LAND. (By Telegraph.—Press Association.) PALMERSTON N., Monday. The Supreme Court is to-day hearing a claim for compensation for land taken in connection with the railway deviation at Palmerston North. The claimant is Henry Walter George Ashworth, and the defendant the Railway Department. Associated with Mr Justice Reed on the Bench are two assessors. The land comprises nearly six acres, for which £2OO an acre is claimed, and a further £3OO for' loss of shelter trees and alleged depreciation of land due to the Department’s operations. •In the statement of claim it Is pointed out that the land was taken in March, 1926. In September, 1929, after the work had been in progress for over three years, the proclamation was revoked, and the land was given back. -It is alleged by claimant that in the interim the'land had been injuriously affected by cuttijigs and drains, and that through the shelter trees being cut grazing stock had been deprived of shelter. The amount claimed was amended at the beginning of the hearing to £1149.
