MOTORIST CHARGED.
THE JURY DISAGREES. NEW TRIAL ORDERED. AUCKLAND, Saturday. Following a disagreement by the jury, a retrial has been ordered in the case of Robert John Burling, aged 24, of Piriaka, who was cbargeVl that on August 2, 1930, he negligently drove a motor-car at Manurcwa, thereby causing the death of Charles Berry Simons, who was a passenger in his car, when the latter collided with a telegraph pole on the Auckland side of the Mahia Bridge. Amongst the witnesses for the defence was the Rev. R. J. Boyt, of Hamilton, who said he met accused in Hamilton after the football match. He spoke to accused for about two minutes, and his condition then was perfectly normal.
