ERECTION OF A BUILDING.

THEATRE OWNER SUED. THE CLAIM REDUCED. (Special to Times.) HUNTLY, Friday. J. B. Sanders, builder, of Huntly, proceeded against Albert Powell, owner of the Lyceum Theatre, claiming £905 in connection with the erection of a brick building next the theatre. At the outset counsel stated that the claim had been reduced to £l4O 19s sd, and the counter-claim, £43 10s, approved by both parties, the partially erected building to conform to the measurements of the defendant, Powell, who alleged that the measurements and lay-out were not according to plans and specifications. The shop and dwelling have been in course of erection since the end of last year, and the work was stopped by defendant pending a legal decision after three stoppages owing to the alleged non-compliance with the plans. . Evidence as given by Sanders and bis wife, who were subjected to a vigorous cross-examination. The hearing was adjourned till the 28th instant.
