AUCKLAND BANKRUPTCY.
PICTURE THEATRE PROPRIETOR. MOTION FOR DISCHARGE. AUCKLAND, Saturday. When a motion for the discharge from bankruptcy of Thomas A. O’Brien, picture theatre propnetoi, came before Mr. Justice Herdman in Ihe Supreme Court yesterday Ills Honour adjourned the matter 'for a few days to enable him to look into a long report on the case. The official assignee, Mr. A. W. Watters, said the creditors were unanimous in recommending the application, and he could not see any reason why he should oppose it. Counsel said it was purely in the interest of ihe creditors that the discharge should be granted. It was to assist O’Brien in the carrying out of his other undertakings, in which the creditors themselves were closely involved. The deficiency shown was a contingent liability dependent upon the Civic Theatre not realising the amount which the Bank of New Zealand had secured over it. It was only if the guarantors had to be called upon that it became a liability.
