SERVICE CAR SMASH.

£507 CLAIMED. JUDGMENT TOR DEFENDANT. The claim for £507 for injuries received in a motor accident, brought in Hamilton Supreme Court by George Charles Hammond, farmer, Cambridge, against William Sherry, service car proprietor, Hamilton, was continued.

Roy Edward Champtaloup, touring manager of the Auckland Automobiii Association, said that taking into consideration the high crown of the road, the behaviour of the car when it left the road was consistent with a hurst front lyre.

In giving judgment for defendant, his Honour said there was no evidence to show that the tyre should not have been used on' the road. Defendant turned the corner before the accident at a speed of 35 miles an hour, a reasonable speed in the circumstances. The cause of the. car's progress to the right of the road was ihe deflation of the front right lyre, and defendant had done all lie could be expected to do under the circumstances.
