MAGISTRATE’S COURT.
SITTING AT MORRINSVILLE. Before Mr Wyvern Wilson, S.M., Patrick Simminton was charged with negligently driving his motor-car in Thames Street on June 1. He pleaded guilty and was fined 20s, with costs 21s. Judgment Summons. Manawalu Farmers’ Freezing and Bacon Company v. J. 11. Williamson; claim £8 Gs 7d.—To pay forthwith, or eight days’ imprisonment. Charles S. Sims v. W. G. Warren; claim £2O 7s. —Ordered to pay 20s monthly. Claim for Damages. The case G. Reynolds v. R. C. Saxon, adjourned from last court day, was a claim for damages caused by defendant’s dog attacking the daughter of Reynolds when she was riding home on her bicycle, and seriously injuring her. Mr McGregor, for defendant, handed in evidence from witnesses, taken in Palmerston North, denying that the dog was the cause of the accident, lie called the defendant, who stated that he was a farmer living near the plaintiff. He was not at home on the day of the accident. Reynolds called at his house two months after, and they had a talk about the accident. Reynolds’s account of what took place at the interview, when giving his evidence, was not correct. Reynolds asked for help to pay the doctor’s bill, and witness agreed to give him a pound or two towards the account, as he did not want to fall out with a neighbour. He did not in any way admit liability. Reynolds' agreed to accept £5 to help him pay the doctor. He afterwards sent an account for the whole of Lite expenses. Cross-examined by .Mr Needham, witness said he had two dogs, they were not savage dogs, and had never attacked anyone. He had since killed one because it would not work properly.
