MOTORIST IN TROUBLE

KILLED A CATTLE DOG. INTERESTING JUDGMENT. At the Tc Aroha Magistrate's Court yesterday, Mr F. W. Platts, S.M., gave his decision respecting a claim made by Robert M. Taylor against Samuel Arthur Puokridge for £lO, the value of a cattle dog killed by defendant's car. Defendant admitted travelling at between 25 and 30 miles per hour. He did not see the dog, as it had jumped out at the last minute. He swerved, but could not avoid the accident. He could have pulled up sooner than ho did. He thought he had missed the dog, but on looking round saw the dog dead. The Magistrate said the evidence proved that defendant was not keeping a proper look-out, and was travelling at an excessive speed. He should have approached dogs and cattle at a reasonable speed, so as to. have his car under control. Defendant admitted travelling at 25 to 30 miles per hour, which, as any motorist knew, is not a speed under which a car is under the best of control. The defendant had also in the same way admitted his negligence by making an offer. Judgment would be given for £7 10s, value of the dog, and £2 10s for general damages.
