AN APPEAL ABANDONED.
CASE OF W. J. BURNETT. £2O DEPOSIT TO BE FORFEITED. CHRISTCHURCH, Saturday. The Racing Conference judges heard an appeal by W. J. Burnett, owner.of the horse Dress Circle, against the decision of the Auckland District Committee in disqualifying him for three years for corrupt practices and imposing a fine of £2O on him for employing an unlicensed trainer. The secretary of the conference presented a telegram received from Messrs Earl and Kent, solicitors, Auckland, reading as follows: “Burnett wil not prosecute the appeal, and asks that the deposit be accepted in payment of the fine.”
The judges being of opinion that appellant should not at this late stage be allowed to abandon his appeal on these terms, and no appearance being made by appellant, and having read the evidence taken before the Auckland District Committee, and being satisfied that there was ample material for the decision arrived at by that committee, have decided that the appeal should be dismissed and that £2O deposited by appellant on lodging his appeal be' forfeited.
