CLAIM FOR BENZINE.
AN ACCOUNT IN DISPUTE.
JUDGMENT FOR PLAINTIFF.
The hearing of a dispute in which F. J. Farrell, garage proprietor, claimed from a motor 'bus proprietor named J. Branton £5 8s 9d, allegedly due for five and a half cases of benzine, supplied in the attention of Messrs R, F. Haycock and B. C. Lowry, J.’sP., at the Magistrate’s Court to-day. Plaintiff was represented by Mr A. L. Tompkins. Mr W. Clavis, instructed by Messrs Gilfillan and Sullivan, represented defendant.
For the plaintiff it was stated that an order had been placed for five cases of benzine. Defendant had called to collect a case from the order, but as delivery had been made he took a half case "to carry on. The cases had been delivered to defendant’s benzine store at Frankton.
The defence was a denial that the goods in question had ever been ordered or delivered. An account had been received, but it bad been disputed by defendant. Mr Haycock said the evidence had been somewbat conflicting, but it was apparent that the benzine was delivered at the defendant’s store. Judgment would be for the plaintiff for the amount claimed. Witnesses’ expenses £1 17s 6d, solicitor’s fee £1 Is, and Court costs £1 Is were allowed.
