SURRENDER OF A FARM.

SETTLER'S CLAIM FOR £2OO.

A NONSUIT ENTERED.

8y Telegraph.—Press Association. AUCKLAND, Tuesday. In the Supreme Court, before Mr Justice Stringer, a soldier-settler named George Edward Mcßoon claimed from the Crown £2OO on an agreement alleged to have been made with the Crown Lands Commissioner, wherebv it was stated that plaintiff, after being incapacitated through illness, surrendered his farm to the Crown on the understanding that he was to get £3OO. Plaintiff had received an advance of £6OO from the Government, and put about £I7OO into the farm of his own money. His counsel stated that the stock on the farm was valued by the department at about £llsO, and was sold by the Department for between £230 and £3OO. The Crown denied that the alleged agreement had been made, and said the Commissioner had no authority to make such an agreement.

The Judge, in nonsuiting plaintiff, said it would be remarkable if the Commissioner had authority lo make such an agreement. His Honor's 1 experience was that the Commissioner had shown every consideration for returned soldiers and endeavoured to help them in every way.
