CLAIM FOR WAGES.

LABOURER’S SUCCESSFUL SUIT. • v. DIFFERENCE AS TO AMOUNT DUE. . A labourer, John Barry, claimed from C. Sheffler, farmer, at the Magistrate’s Court, Hamilton, this morning, £l7 is Sd, balance of wages allegedly due. Mr King appeared for plaintiff, and Mr Seymour for defendant. It was admitted by the defence that a certain amount of wages was due on the basis of 30s per week, and the only point on which there was any difference of opinion was as to whether there was an agreement reached for an increase of 10s per week from October last. Plaintiff contended that he had previously agreed with defendant to work as a general farm -labourer for 30s per week and found. Some time later defendant agreed to pay him £2 per week if he would stay over the milking season.

Defendant denied that he had made any arrangements for an increase in pay. He burst into tears when describing the various alleged shortcomings of plaintiff—how lie had refused to hold a badly injured horse while defendant went to ring for a veterinary surgeon, etc. Plaintiff was a most unsatisfactory man, and defendant had employed him more out of sympathy. His Worship held that Barry received some inducement to stay on, and accordingly gave judgment for the full amount clairhcd, with Court costs £2 10s, witnesses’ expenses 12s, and solicitor’s fee £3 3s.
