ALLEGED NEGLIGENCE
IDENTITY NOT PROVED. ACCIDENT SEQUEL. The case in which a Dalmatian named Joe Sumich, farm labourer, of Taupiri, sued Malcolm McGregor, farmer, of Hamilton, for £BB2 damages for injuries received through defendant’s alleged negligent driving of his motor oar, was concluded in the Supreme Court yesterday. Both counsel addressed the jury at length. After a short retirement the jury found that plaintiff had failed to prove that it was defendant’s car which caused the accident. Judgment was therefore entered for defendant with costs on the higher scale.
