MONEY IN SAVINGS BANK
IS IT ATTACHABLE? (By Telegraph.—Press Association.! WELLINGTON, Tuesday. An interesting legal point was raised' in the Magistrate’s Court upon an; application on behalf of a judgment creditor for an order attaching moneys lying to the judgment debtor’s credit at the Post Office Savings Bank., Counsel said an interlocutory order had bfien served upon the postal authorities, but it was returned with a denial of th* power of-the Magistrate’s Court to make an order against the debt on the ground that 0 the money deposited in the Post Office Bank was the properly of the Crown, therefore the Magistrate’s Court had no. jurisdiction to make an order. The Grown was not represented. Mr Bailey, 'S.M., who reserved his decision, expressed his opinion that if the law proved that moneys could not be attached, it should he remedied, as it was extremely unfair that a debtor should be able to- evade his creditors by locking up money in the Post Office Savings Bank.
