MAGISTRATE'S COURT, TE AWAMUTU.
TUEoDAY. (Before Mr H. W. Northcroft, S.M,) MltS W. HUGHES V. THUS. IIUUHES. This was an interpleader summons claiming ownership to two horses taken under a distress wurran.. .Mr MacDiarund (instructed by Mr Swarbrick) appeared for the claimant, and Mr Collins for the exouutioj creditor. A number of witnesses were ealiea on either side, aud the Magistrate dismissed the summons with ill 15s costs. JUDGMENT SUMMONB. Thompson (Mr Collins) v. Loaning.— wds a judgment summons and an order was made for payment of the whole amount forthwith and costs .£1 Bs, in default one month's imprisonment. A SKUIOUS CHARGE. Two young mnu, named Moody and Elmsley, were charged by Constable Fitzgerald with killing two ducks, the property of T. H. Chapman, and further with destroying 15 fruit trees, the property of U. B. Miller. Mr Miller stated tha«; a number of his fruit trees, from 5 to 7 years old and in full bloom, were pulled up. The damage done would be from £2O to £2s. Mr Chapman stated that ho found his two ducks one morning with their neckß broken aud then placed the matter into the hands' of the police. He asked to magistrate to deal leniently with the two defendants, who had expressed their sorrow. Air Collins who appeared for the defendants, pleading guilty, asked the Magistrate to take into consideration the '' fact that the young men came from respectable families, and here the Magistiate remarked, "Then there is lesa excase." I The Magistrate said the whole offence showed a very vicious disposition. this was wanton aud cowardly mischief, aud had they been younger a thrashing would have been ordered. The cases in the meantime would be adjourned until the following morning, and the two young men were put mto the cells at Te Awamutu. ;
