THE FENCOURT-EUREKA DAM
In reference to the dispute between the Eureka and Fencourt Drainage Hoards, in regard to the dam, Mr Northcroft, S.M., who acted as arbitrator has delivered the following awardl. That the said dam shall be foithwith removed by and at the expense of the Eureka Drainage Board. 2. That if the Eureka Drainage Board desires to construct a new dam, the eaid Board shall be at liberty to construct the same, but the floor of such new dam must he constructed of wooden planks. 3. The bottom of the said new dam shall be lowered as the bi i of the creek becomea lowered by the action of the ruuuing water, i. 'lhe new dam (if constructed) shall be designed by and constructed to'the satisfaction of the Government Engineer, for the time being, in charge of the Waikato district. 5. Suck new dam, if constructed as aforesaid, shall be constructed, maintained and altered as aforesaid, at the sole cost of the Eureka Drainage Board. 6. i hat the costs of the said reference and this award, amounting £l7 17s 6d, as hereafter spc fiei, shall be forthwith paid by tbe Eureka Drainage Board, viz , D. Stubbins £2 2s, R. Sw iyne 10-5, R. Hannon 10s, T. Hartly 10s, legal expenses £3 13s, Arbitrator s fee and preparation and stamping • ward, £lO 12s 6d. Total £l7 17s (3d.
